He shouldn't arrested for 'breach of the peace' because he didn't. 'breach of the peace' means public disturbance, not once did he make any noise, sound or signal which unreasonably disturbs the comfort or peace of another person.

He was rightly arrested for breach of the peace.
The fact that led to no charge does not mean he was incorrectly arrested.
In case you didn't know, it's "arrested on suspicion of...". Further investigations showed there may well have not been enough evidence to lead to a charge for breach of the peach ( WILL NOBODY THINK OF THAT POOR PEACH! ) but given the suspended sentence, charge of contempt of court was appropriate.

The degree of ignorance (or deliberate misunderstanding of the law ) Is shocking.
I could be arrested for breach of the peace outside the Liberty but then changed and sentenced with ABH. 3 months suspended for 2 year. A few weeks later I do exactly the same thing. The suspended sentence immediately becomes live and I will be sent down for 3 months. But, because the second offence is identical to the first the only thing that will happen if I plead not guilty is a trial at a later date and heavier sentence, I still go straight to clink for the first offence. So, I own up and plead guilty. That plea is taken and the sentence past

Orwellian police?? If they had been Orwellian his phone would have been taken off him immediately.
