Receivership questions 14:29 - Oct 4 with 1259 viewsRangersDave

Hi chaps,

Having gone through this this last 16 months, i must say that the receivers have been rather quiet regarding contact with myself, however an interesting conundrum has cropt up today......

Firstly let me state that i put £45k into the company in the shape of a secured loan (gulp)

Ok, today it has come to my notice that 2 company's (possibly 3) are now selling items made from my tools.
I paid 98k for 1 set of tools to produce 1 item
i also paid 80k for 1 set of tools for another item
and lastly i paid 58k for another set of tools for another item

To another factory i paid 12k for another set of tools, and 6k for 50% payment to another set of tools.

None of these are listed on the receivership assets, and i'm still out 45k

Any ideas what i should /could do...... if anything?

Have you got a solicitor? It sounds like it might be worth investing on one who specialises in this area and looks after your interests and not the company's. You don't have to go as far as suing but you might get some advice about how to proceed next, what your rights are and they may send a letter on your behalf for not too much cash.

Hi mate, yes it is.

I have a letter of ownership for 2 of my tools (circa 180k investment) and at least 1 of those items is now being made for a third party for sale in the UK.

Another item, which i paid in full but never got a letter of ownership for is aslo being sold in the uk by who would have been a rival.

None of these show as assets on the receivers declaration as China wouldnt talk to the receiver.

As an addition,

I have found a 4th and 5th product from tools i owned being sold by 2 companies, and nothing from the Receivers except they wrote to the companies in China and got no response.

Meanwhile i wave goodbye to over a third of a mill of tooling.

make that another product, and i have found out that the product has already been imported into the UK and sold to end user customers.

I've calculated thats 1/4 mill in product alone, so far
