Read it properly. McKay junior was the agent of Nantes for the transfer itself. Neither he nor his dad were their agent for the separate purpose of organising transport. It’s quite simple. Nantes cannot be held liable for something done by someone who was not their agent and who were unaware of any illegality. |  | |  |

The agents team organised the transfer for Nantes and would take a commission off Nantes not Cardiff. The Agency (father and son) has admitted they organised the flight ( at rock bottom prices ) and the firm that found them the aeroplane stated the Agency knew the flights were not fully confirming with rigorous UK regulations because he told them. Resolven you keep ignoring the fact that the transfer was concluded and there was no agency between Nantes and McKay to arrange transport. Any agency the club had with the agent for the purposes of the transfer was over when the deal concluded. This was simply a post transfer arrangement made by the agent of Sala not of Nantes. Nantes role in this was over when the transfer concluded. The did not have any responsibility to arrange transport and it was held they did not do so. |  | |  |

The agent paid the illegal pilot cash reports the BBC. £270. So who employed the pilot? Henderson did not pay him.. the Agent representing Nantes paid him it seems. Was he a legal pilot. No he was an illegal pilot. Due diligence and duties f cars woefully absent. No wonder bad agents a exist in football. Most fans back them all the way and accept their ways. Like most of football . CCFC failed to establish that the McKay ordered the flight. They had no evidence that he did so. There is a reasonable scenario where Sala wanted to get to Cardiff that night, or possibly wanted to avoid a frustrating journey in the morning, and McKay said "I've used this guy, he might help you". So CCFC needed evidence that McKay organized it, and they had none. Add to that, McKay is not a full time employee of Nantes, he was a contractor, so even if they showed that he did organize it, they would then have to also show that he did so at the behest of Nantes for any liability to attach. Why would Nantes have done that? He was no longer their player and not their problem. CCFC don't seem to have any evidence of that either. Then you can add that the Court signalled that the negligence occurred not by ordering the flight, but by the air transport company switching the pilot the usual gut to an unlicenced man. Yes most of these incidents are caused by haphazard maintenance and corner/cost cutting with repairs rather than pilot error or the ability of the plane itself though. In the Sala case there was lethal carbon monoxide leaking into the cabin they were probably both dead before anyone realised there was a problem. Reputable airlines have to submit swathes of maintenance documents before they can even push off from the gates. These cowboys can just sellotape the wing back on and take off. |  |
